Selective Incorporation Through the Fourteenth

Captions available

The idea

Originally the Bill of Rights bound only the national government. Since the Civil War, through the Fourteenth Amendment and a series of Supreme Court decisions, most of its protections have been extended to state action by selective incorporation, still under way.

In practice

The Fourteenth's due process clause as the vehicle.

Where people slip

Grand juries, the anchor notes, are one guarantee never incorporated.
