The idea
Assault and battery are intentional torts.
In practice
Assault is intentionally making a person reasonably fear harmful or offensive contact; battery is actually making harmful or offensive contact without consent.
Where people slip
Touching a patient for a procedure they have refused can be battery, however well meant the touch is.
