History of the United States I / Unit 10   USH1 1395 worked example, 60 to 90 seconds

A Holding Ignored

The idea

The Court ruled for the Cherokee and nothing followed from it. Georgia continued to legislate over Cherokee land, the federal executive declined to intervene, and removal proceeded on schedule. The decision is remembered as a landmark in federal Indian law and it protected nobody at the time it was handed down.

In practice

A judgment of the Supreme Court of the United States with no mechanism behind it.

Where people slip

Draw the general principle carefully. Courts depend on the other branches to enforce what they decide, and when the executive declines, a right exists on paper and nowhere else. Students meet this again with Reconstruction in Unit 16, where constitutional amendments guaranteeing Black citizenship went unenforced for a century. The pattern is the same and it is worth naming here, the first time the course can show it whole.
